Terms

Terms of use and purchase.

Who sells and who provides the service

Live Captions is software made by Duwan Fortunato Peña Gómez, an individual based in Villa del Rosario, Norte de Santander, Colombia (“we”). We make the app and support it.

Subscriptions are sold by Polar (polar.sh), which acts as Merchant of Record and reseller: it charges you, sends you the invoice, and calculates and pays the taxes that apply in your country. When you buy, you also accept Polar’s terms for the payment.

Acceptance

By creating an account or using Live Captions you accept these terms. You must be at least 18 years old to use it.

License and your content

Live Captions is ours. We give you a personal, non-exclusive, non-transferable permission to use it while you follow these terms. You may not resell it, distribute it or extract its code, except where the law allows it.

Your meetings, transcripts, translations and notes are yours. We only use them to provide the service, as explained on the privacy page.

Plans

Free: 5 meetings per calendar month, counted in UTC time. A meeting that starts always finishes in full. It includes the assistant with 20 questions and 5 notes a month, with automatic alerts only in the account’s first 3 meetings.

Pro: unlimited meetings and the assistant with 300 questions and 30 notes a month, under the fair use described below and with automatic alerts only in the account’s first 3 meetings, for US$12 a month or US$96 a year.

Pro Plus: unlimited meetings and the assistant with 1,000 questions and 100 notes a month, under the fair use described below, plus automatic alerts when someone asks you something, which don’t use questions, for US$20 a month or US$144 a year.

Prices are in US dollars and taxes are calculated at checkout.

If you go from Pro or Pro Plus to Free, nothing is hidden or deleted: your saved meetings stay there.

Automatic renewal

The subscription renews on its own at the end of each period, monthly or yearly, and is charged to the same payment method until you cancel it. If the price changes, we’ll tell you before the next renewal.

If you used a discount code, including the tester code, the discount ends when its period is over and the plan renews at the normal price, unless you cancel before. Polar asks you for a card even when the discount covers the full price.

If a renewal payment fails, your plan stays active for up to 7 days while the payment is retried.

Cancellation

You can cancel any time from the app, in Settings › Plan, or from Polar’s customer portal. You aren’t charged again and you keep your plan until the end of the period you already paid for.

Refunds

If you ask within 14 days after a charge, whether the first purchase or a renewal, monthly or yearly, we refund the full amount of that charge, with no need to explain why. Email us at hola@livecaptionsapp.com from your account’s email. Polar refunds it to the same payment method within 15 calendar days of your request.

After those 14 days we don’t refund the current period, unless a fault on our side kept you from using the app; in that case, email us and we’ll look into it.

A full refund ends your plan at once. A partial refund doesn’t change your plan.

Fair use of the included assistant

Each plan includes a number of questions and notes per month, which renew on the 1st of each month, in UTC time. Each question, “What did I miss?”, “Explain” and each context extraction use one question; preparing the notes for a meeting uses one note. Pro Plus automatic alerts don’t use questions. What you don’t use in a month doesn’t carry over to the next. If they run out, the assistant or the notes come back on the 1st; on Free and Pro you can also change plans. To protect the service, unusually heavy use may pause the assistant before those numbers are reached, until the 1st. Captions and translation keep working in every case.

The included assistant is for understanding your meetings. If it is used for something else, for example as a general AI service, we may suspend the included assistant for that account.

Third-party services

The assistant, notes and context extraction go through our server to OpenRouter, which sends them to AI providers that state they don’t store what they receive. That use is included in your plan’s price, within fair use. Deepgram is an optional transcription engine you use with your own account and isn’t included in any plan: Deepgram charges you directly for what you use, under its own terms.

Acceptable use

Use it only lawfully. Do not transcribe or record other people without the notice or consent required by the law of your country or your company’s rules. Do not try to harm the service or access accounts that aren’t yours.

If someone breaks these terms, we may suspend their account.

What the app can get wrong

Captions, translation, the assistant and notes are produced by automatic software and may contain errors, leave things out or misunderstand what was said. Don’t use them as the only basis for medical, legal, financial or safety decisions: confirm what matters with the people in the meeting.

We offer Live Captions as is and as available. We do our best for it to work well, but we don’t guarantee that it works without interruptions or errors, or on every computer. The Windows version is in beta.

Limitation of liability

To the extent the law allows, we aren’t liable for indirect damages or for loss of data, profits or opportunities. Our total liability for any claim is limited to what you paid for Live Captions in the 12 months before the claim, or US$50 if that is more.

None of this limits liability that the law doesn’t allow to be limited, such as liability for fraud or gross negligence, or your rights under consumer protection law.

Changes to these terms

If we change these terms, we publish the new version here with its date. If the change affects you in an important way, we tell you beforehand in the app or by email. If you keep using Live Captions afterwards, you accept the new version.

Governing law and disputes

These terms are governed by the laws of the Republic of Colombia. If you have a claim, email us first so we can try to resolve it directly. If we can’t, the claim goes to the competent courts of Colombia or, if you are a consumer in Colombia, also to the Superintendencia de Industria y Comercio.

If you live in another country, you keep the consumer protections of your country that can’t be waived, and you may go to its courts when that law allows it.
